1757 ई. की प्लासी की लड़ाई और 1764 ई. में बक्सर के युद्ध को अंग्रेजों द्वारा जीत लिए जाने के बाद बंगाल पर ब्रिटिश ईस्ट इंडिया कंपनी ने शासन का शिकंजा कसा. इसी शासन को अपने अनुकूल बनाए रखने के लिए अंग्रेजों ने समय-समय पर कई एक्ट पारित किए, जो भारतीय संविधान के विकास की सीढ़ियां बनीं. ये एक्‍ट्स इस प्रकार थे:

(1) 1773 ई. का रेग्‍यूलेटिंग एक्ट: इस एक्ट के अन्‍तर्गत कलकत्ता प्रेसिडेंसी में एक ऐसी सरकार स्थापित की गई, जिसमें गवर्नर जनरल और उसकी परिषद के चार सदस्य थे, जो अपनी सत्ता का उपयोग संयुक्त रूप से करते थे. इसकी मुख्य बातें इस प्रकार हैं:(i) कंपनी के शासन पर संसदीय नियंत्रण स्थापित किया गया.

(ii) बंगाल के गवर्नर को तीनों प्रेसिडेंसियों का जनरल नियुक्त किया गया.

(iii) कलकत्ता में एक सुप्रीम कोर्ट की स्थापना की गई.

(2) 1784& ई. का पिट्स इंडिया एक्ट: इस एक्ट के द्वारा दोहरे प्रशासन का प्रारंभ हुआ-

(i) कोर्ट ऑफ डायरेक्टर्स- व्यापारिक मामलों के लिए.

(ii) बोर्ड ऑफ कंट्रोलर- राजनीतिक मामलों के लिए.

(3) 1793 ई. का चार्टर अधिनियम: इसके द्वारा नियंत्रण बोर्ड के सदस्यों तथा कर्मचारियों के वेतन आदि को भारतीय राजस्व में से देने की व्‍यवस्‍था की गई.

(4) 1813 ई. का चार्टर अधिनियम: इसके द्वारा

(i) कंपनी के अधिकार-पत्र को 20 सालों के लिए बढ़ा दिया गया.

(ii) कंपनी के भारत के साथ व्यापर करने के एकाधिकार को छीन लिया गया. लेकिन उसे चीन के साथ व्यापर और पूर्वी देशों के साथ चाय के व्यापार के संबंध में 20 सालों के लिए एकाधिकार प्राप्त रहा.

(iii) कुछ सीमाओं के अधीन सभी ब्रिटिश नागरिकों के लिए भारत के साथ व्यापार खोल दिया गया.

(5) 1833 ई. का चार्टर अधिनियम: इसके द्वारा

(i) कंपनी के व्यापारिक अधिकार पूर्णतः समाप्त कर दिए गए.

(ii) अब कंपनी का कार्य ब्रिटिश सरकार की ओर से मात्र भारत का शासन करना रह गया.

(iii) बंगाल के गवर्नर जरनल को भारत का गवर्नर जनरल कहा जाने लगा.

(iv) भारतीय कानूनों का वर्गीकरण किया गया तथा इस कार्य के लिए विधि आयोग की नियुक्ति की व्यवस्था की गई.

(6) 1853 ई. का चार्टर अधिनियम: इस अधिनियम के द्वारा सेवाओं में नामजदगी का सिद्धांत समाप्त कर कंपनी के महत्वपूर्ण पदों को प्रतियोगी परीक्षाओं के आधार पर भरने की व्यवस्था की गई.

(7) 1858 ई. का चार्टर अधिनियम: इसके तहत

(i) भारत का शासन कंपनी से लेकर ब्रिटिश क्राउन के हाथों सौंपा गया.

(ii) भारत में मंत्री-पद की व्यवस्था की गई.

(iii) 15 सदस्यों की भारत-परिषद का सृजन हुआ.

(iv) भारतीय मामलों पर ब्रिटिश संसद का सीधा नियंत्रण स्थापित किया गया.

(8) 1861 ई. का भारत शासन अधिनियम: इसके तहत

(i) गवर्नर जनरल की कार्यकारिणी परिषद का विस्तार किया गया.

(ii) विभागीय प्रणाली का प्रारंभ हुआ.

(iii) गवर्नर जनरल को पहली बार अध्यादेश जारी करने की शक्ति प्रदान की गई.

(iv) गवर्नर जरनल को बंगाल, उत्तर-पश्चिमी सीमा प्रांत और पंजाब में विधान परिषद स्थापित करने की शक्ति प्रदान की गई.

(9) 1892 ई. का भारत शासन अधिनियम: इसके तहत

(i) अप्रत्यक्ष चुनाव-प्रणाली की शुरुआत हुई.

(ii) इसके द्वारा राजस्व एवं व्यय अथवा बजट पर बहस करने तथा कार्यकारिणी से प्रश्न पूछने की शक्ति दी गई.

(10) 1909 ई० का भारत शासन अधिनियम [मार्ले -मिंटो सुधार]: इसके तहत

(i) पहली बार मुस्लिम समुदाय के लिए पृथक प्रतिनिधित्व का उपबंध किया गया.

(ii) भारतीयों को भारत सचिव एवं गवर्नर जनरल की कार्यकारिणी परिषदों में नियुक्ति की गई.

(iii) केंद्रीय और प्रांतीय विधान-परिषदों को पहली बार बजट पर वाद-विवाद करने, सार्वजनिक हित के विषयों पर प्रस्ताव पेश करने, पूरक प्रश्न पूछने और मत देने का अधिकार मिला.

(iv) प्रांतीय विधान परिषदों की संख्या में वृद्धि की गई.

(11) 1919 ई० का भारत शासन अधिनियम [मांटेग्यू चेम्सफोर्ड सुधार]: इसके तहत

(i) केंद्र में द्विसदनात्मक विधायिका की स्थापना की गई- प्रथम राज्य परिषद तथा दूसरी केंद्रीय विधान सभा. राज्य परिषद के सदस्यों की संख्या 60 थी; जिसमें 34 निर्वाचित होते थे और उनका कार्यकाल 5 वर्षों का होता था. केंद्रीय विधान सभा के सदस्यों की संख्या 145 थी, जिनमें 104 निवार्चित तथा 41 मनोनीत होते थे. इनका कार्यकाल 3 वर्षों का था. दोनों सदनों के अधिकार समान थे. इनमें सिर्फ एक अंतर था कि बजट पर स्वीकृति प्रदान करने का अधिकार निचले सदन को था.

(ii) प्रांतो में द्वैध शासन प्रणाली का प्रवर्तन किया गया. इस योजना के अनुसार प्रांतीय विषयों को दो उपवर्गों में विभाजित किया गया- आरक्षित तथा हस्तांतरित. आरक्षित विषय थे - वित्त, भूमिकर, अकाल सहायता, न्याय, पुलिस, पेंशन, आपराधिक जातियां, छापाखाना, समाचार पत्र, सिंचाई, जलमार्ग, खान, कारखाना, बिजली, गैस, व्यालर, श्रमिक कल्याण, औघोगिक विवाद, मोटरगाड़ियां, छोटे बंदरगाह और सार्वजनिक सेवाएं आदि.

हस्तांतरित विषय:

(i) शिक्षा, पुस्तकालय, संग्रहालय, स्थानीय स्वायत्त शासन, चिकित्सा सहायता.

(ii) सार्वजनिक निर्माण विभाग, आबकारी, उघोग, तौल तथा माप, सार्वजनिक मनोरंजन पर नियंत्रण, धार्मिक तथा अग्रहार दान आदि.

(iii) आरक्षित विषय का प्रशासन गवर्नर अपनी कार्यकारी परिषद के माध्यम से करता था; जबकि हस्तांतरित विषय का प्रशासन प्रांतीय विधान मंडल के प्रति उत्तरदायी भारतीय मंत्रियों के द्वारा किया जाता था.

(iv) द्वैध शासन प्रणाली को 1935 ई० के एक्ट के द्वारा समाप्त कर दिया गया.

(v) भारत सचिव को अधिकार दिया गया कि वह भारत में महालेखा परीक्षक की नियुक्ति कर सकता है.

(vi) इस अधिनियम ने भारत में एक लोक सेवा आयोग के गठन का प्रावधान किया.

(12) 1935 ई० का भारत शासन अधिनियम: 1935 ई० के अधिनियम में 451 धाराएं और 15 परिशिष्‍ट थे. इस अधिनियम की मुख्य विशेषताएं इस प्रकार हैं:

(i) अखिल भारतीय संघ: यह संघ 11 ब्रिटिश प्रांतो, 6 चीफ कमिश्नर के क्षेत्रों और उन देशी रियासतों से मिलकर बनना था, जो स्वेच्छा से संघ में सम्मलित हों. प्रांतों के लिए संघ में सम्मिलित होना अनिवार्य था, लेकिन देसी रियासतों के लिय यह एच्छिक था. देशी रियासतें संघ में सम्मिलित नहीं हुईं और प्रस्तावित संघ की स्थापना संबंधी घोषणा-पत्र जारी करने का अवसर ही नहीं आया.

(ii) प्रांतीय स्वायत्ता: इस अधिनियम के द्वारा प्रांतो में द्वैध शासन व्यवस्था का अंत कर उन्हें एक स्‍वतंत्र और स्वशासित संवैधानिक आधार प्रदान किया गया.

(iii) केंद्र में द्वैध शासन की स्थापना: कुछ संघीय विषयों [सुरक्षा, वैदेशिक संबंध, धार्मिक मामलें] को गवर्नर जनरल के हाथों में सुरक्षित रखा गया. अन्य संघीय विषयों की व्यवस्था के लिए गवर्नर- जनरल को सहायता एवं परामर्श देने हेतु मंत्रिमंडल की व्यवस्था की गई, जो मंत्रिमंडल व्यवस्थापिका के प्रति उत्तरदायी था.

(iv) संघीय न्‍यायालय की व्यवस्था: इसका अधिकार क्षेत्र प्रांतों तथा रियासतों तक विस्तृत था. इस न्यायलय में एक मुख्य न्यायाधीश तथा दो अन्य न्यायाधीशों की व्यवस्था की गई. न्यायालय से संबंधित अंतिम शक्ति प्रिवी काउंसिल [लंदन] को प्राप्त थी.

(v) ब्रिटिश संसद की सर्वोच्चता: इस अधिनियम में किसी भी प्रकार के परिवर्तन का अधिकार ब्रिटिश संसद के पास था. प्रांतीय विधान मंडल और संघीय व्यवस्थापिका: इसमें किसी प्रकार का परिवर्तन नहीं कर सकते थे.

(vi) भारत परिषद का अंत: इस अधिनियम के द्वारा भारत परिषद का अंत कर दिया गया.

(vii) सांप्रदायिक निर्वाचन पद्धति का विस्तार: संघीय तथा प्रांतीय व्यवस्थापिकाओं में विभिन्न सम्प्रदायों को प्रतिनिधित्व देने के लिए सांप्रदायिक निर्वाचन पद्धति को जारी रखा गया और उसका विस्तार आंग्ल भारतीयों - भारतीय ईसाइयों, यूरोपियनों और हरिजनों के लिए भी किया गया.

(viii) इस अधिनियम में प्रस्तावना का आभाव था.

(13)1947 ई० का भारतीय स्वतंत्रता अधिनियम:ब्रिटिश संसद में 4 जुलाई, 1947 ई० को भारतीत स्वतंत्रता अधिनियम प्रस्तावित किया गया, जो 18 जुलाई, 1947 ई० को स्वीकृत हो गया. इस अधिनियम में 20 धाराएं थीं. अधिनियम के प्रमुख प्रावधान निम्न हैं:

(i) दो अधिराज्यों की स्थापना: 15 अगस्त, 1947 ई० को भारत एवं पाकिस्तान नामक दो अधिराज्य बना दिए जाएंगें, और उनको ब्रिटिश सरकार सत्ता सौंप देगी. सत्ता का उत्तरदायित्व दोनों अधिराज्यों की संविधान सभा को सौंपा जाएगा.

(ii) भारत एवं पाकिस्तान दोनों अधिराज्यों में एक-एक गवर्नर जनरल होंगे, जिनकी नियुक्ति उनके मंत्रिमंडल की सलाह से की जाएगी.

(iii) संविधान सभा का विधान मंडल के रूप में कार्य करना- जब तक संविधान सभाएं संविधान का निर्माण नई कर लेतीं, तब तक वह विधान मंडल के रूप में कार्य करती रहेंगीं.

(iv) भारत-मंत्री के पद समाप्त कर दिए जाएंगें.

(v) 1935 ई० के भारतीय शासन अधिनियम द्वारा शासन जब तक संविधान सभा द्वारा नया संविधान बनाकर तैयार नहीं किया जाता है; तब तक उस समय 1935 ई० के भारतीय शासन अधिनियम द्वारा ही शासन होगा.

(vi) देशी रियासतों पर ब्रिटेन की सर्वोपरिता का अंत कर दिया गया. उनको भारत या पाकिस्तान किसी भी अधिराज्य में सम्मलित होने और अपने भावी संबंधो का निश्चय करने की स्वतंत्रता प्रदान की गई.
